Rhythm Fm – Terms and Conditions of Use

These Terms and Conditions (“Terms”) govern your use of the Rhythm Fm mobile application (“the App”), which is owned and operated by Voice Of Asia Network (Pvt) Ltd (“Company”, “we”, “us”, or “our”) from Sri Lanka. By downloading, accessing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.
2. The Service
The Rhythm Fm App is provided to you free of charge for the sole purpose of listening to the live audio stream of Rhythm Fm radio.
3. Intellectual Property Rights
- Ownership: The App, the radio content streamed, the logo, the design, and all intellectual property rights related to the App and its content are the exclusive property of Voice Of Asia Network (Pvt) Ltd and are protected by Sri Lankan and international copyright, trademark, and other intellectual property laws.
- License to User: We grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the App on your mobile device solely for your personal, non-commercial use.
- Prohibitions: You may not copy, reproduce, reverse engineer, decompile, modify, transmit, distribute, or otherwise exploit any part of the App or its content without our prior written permission.
4. Prohibited Uses
You agree not to use the App in any way that:
- Is unlawful, fraudulent, or violates any applicable local, national, or international law, including the laws of Sri Lanka.
- Involves the unauthorized capture, recording, or rebroadcasting of the radio stream.
- Harasses, abuses, or harms another person.
- Involves reverse engineering, tampering with, or unauthorized access to the App’s servers or code.
- Allows the use of the App to develop any competing product or service.
5. Disclaimer of Warranties
The App is provided to you on an “AS IS” and “AS AVAILABLE” basis.
- NO WARRANTIES: To the fullest extent permissible pursuant to applicable law, we expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We do not warrant that the App will meet your requirements, be uninterrupted, timely, secure, or error-free, or that defects will be corrected.
6. Limitation of Liability
Voice Of Asia Network (Pvt) Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), resulting from:
- The use or the inability to use the App;
- The cost of procurement of substitute goods and services;
- Any reliance placed by you on any content obtained through the App.
- Any error, omission, interruption, deletion, defect, delay in operation or transmission, or computer virus.
7. Indemnification
You agree to indemnify and hold harmless Voice Of Asia Network (Pvt) Ltd from any and all claims, damages, expenses, liabilities, and costs (including legal fees) arising from your use of the App or your breach of these Terms.
8. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of material changes by posting the new Terms within the App or on our website. Your continued use of the App after the effective date of the new Terms constitutes your acceptance of the changes.
9. Governing Law and Jurisdiction
- Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
- Jurisdiction: Any legal action or proceeding arising out of or related to these Terms or the App shall be brought exclusively in the courts of Colombo, Sri Lanka, and you consent to the exclusive jurisdiction of such courts.
